| Board of Public Works commissioners are appointed by the Mayor and confirmed by the City Council. A full term is five years. If a commissioner is appointed to an unexpired term, he or she will serve until the expiration of that term. Upon termination of the term of service, he or she will continue as a commissioner until a successor has been appointed and confirmed.
Commissioners may resign at any time. Upon resignation, the Mayor, subject to confirmation by the City Council, will appoint a successor for the remainder of the unexpired term.
The Mayor may request a commissioner to resign at his or her discretion. It has become customary for incoming Mayors to request the resignation of all commissioners. The Mayor may remove any commissioner who does not resign, and appoint a successor. In accordance with the City Charter provision, a commissioner may be removed by the Mayor without Council confirmation.
Commissioners must be qualified electors of the City of Los Angeles and remain so during their term of office. Should a commissioner be absent from the City for more than 60 days without the permission of the Mayor and City Council, under the provisions of the City Charter, he or she is considered to have resigned from office.
Section 49.50 of the Los Angeles Municipal Code limits the types of activities commissioners may engage in after their term of service with the City has ceased.
